Booking Terms & Conditions

  • Courses, classes and playshops are referred to herein as “open courses”.
  • Retreats and facilitation/training services are referred to herein as “in-house provision”.
  • Coaching sessions/programmes and consultations are referred to herein as “consultant services”.
  • ‘The Provider’ and ‘we’ as described herein references Express Your Curve or it’s partner consultancy, CreaTEAvity Consultancy.

 

1. Booking

1.1 Open courses, in-house provision and consultant services may be booked by telephone, e-mail, online booking, online event-booking platforms (where applicable), or in writing. If booked by telephone, the booking must be confirmed in writing within 7 days of the original booking, with payment in full.

1.2 Payment details to be provided with bookings.

1.3 By submitting a booking by any of the forms mentioned as above in item 1.1, the booking form constitutes a legally binding contract. It may be necessary for reasons beyond our control to change the content and timings of open courses in-house provision and consultant services, including change of training staff, the date or the venue. In the unlikely event of a open course, in-house provision or consultant services being cancelled, we will automatically make a full refund but hereby disclaim any further liability. Should the open course or in-house provision takes place but you are unable to attend, whether for reasons within or beyond your control, the conditions below in relation to transfers and cancellations will apply. The Provider accepts no responsibility for loss occasioned to any person acting or refraining from action as a result of the information disclosed by The Provider during an open course, in-house provision or consultant services.

1.3 Multiple booking discounts are applicable only to delegates booked at the same time for the same open course, and may not be used in conjunction with any other special discount or offer which may be offered from time to time. Unless otherwise stated, any discount available on an event may not be used in conjunction with any other special discount or offer which may be offered from time to time.

1.4 In accordance with cooling-off legal requirements, you (the Client) may request to withdraw your booking within 14 calendar days of sign-up, by following the Cancellation procedure below (item 9.). However, should The Provider have already despatched materials or log-in details to you (the Client), this nullifies the cooling-off period as services are deemed to have been accepted and provided by you (the Client) upon receipt of aforesaid materials.

1.5 Retreat bookings are covered by specific terms and conditions, please refer to your specific retreat’s booking terms and conditions. 

 

2. Payment

2.1 Payment for training courses and workshops is due on registration unless otherwise agreed in advance, in order to release materials or reserve your place. In some instances, payment may be requested by invoice which is due within 7 working days of invoice date. The Provider reserve the right to cancel consultant services, in-house provisions or remove access to open courses should the invoice not be paid by the due date. The Provider reserves the right to charge interest on outstanding invoices at the rate of 2% per calendar month.

2.2 Payment for workshops and training organised by companies and organisations is due in advance of workshop date(s), by the date specified on the relevant invoice.

2.3 Please note that online bookings and payments may take 3-5 working days to process.  If you have not heard from The Provider within 3-5 working days, it is your responsibility to contact The Provider to confirm booking and payment has been received.

2.4 Please contact The Provider to confirm method of payment if the open course, in-house provision or consultant service requested is due within the next 7 days.

2.5 The Provider reserves the right to re-allocate the course place to another participant if fees are not paid on time, or in accordance with any agreement made.

2.6 Retreat bookings are covered by specific terms and conditions, please refer to your specific retreat’s booking terms and conditions.

 

3. Prices/Fees

3.1 All prices are stated on the relevant pages of our websites or via an online event-booking platform. Open courses, in-house provision and consultant services will be charged at the current rate at the time of booking. For further information and group bookings please contact The Provider via the appropriate Contact page.

3.2 The Provider has the right to amend the price of open course, in-house provision or consultant services at any time. However, if a booking has already been made, you (the Client) will be charged the price as quoted at the time of the booking, unless item 2.4 (above) applies.

3.3 Payment for all consultant services, in-house provision or open courses booked and confirmed by you (the Client) must be made prior to the training course or session taking place, unless otherwise agreed in writing. Payment may be made by Stripe, PayPal or Bank Transfer (drawn on a UK Sterling account).

3.4 Retreat bookings are covered by specific terms and conditions, please refer to your specific retreat's booking terms and conditions.

 

4. Transferring open courses

4.1 The following charges will apply for all transfers of open courses to a later date:

  • 25% of the fee up to 30 calendar days prior to the date booked
  • 50% of the fee up to 14 calendar days prior to the date booked
  • 100% of the fee up to 7 calendar days prior to the date booked

4.2 Delegates wishing to transfer may contact The Provider via telephone or email, using the relevant ‘Contact’ page.

4.3 The transfer option only relates to participants who are transferring to a different date on the same open course.

4.4 The choice of course date must be specified at the time of transfer, otherwise the instruction will be considered a cancellation and cancellation fees apply.

4.5 The option to transfer participants may only be used once, after which any further request for transfer will be considered a cancellation.

4.6 All outstanding invoices will remain due, irrespective of the number of working days notice given for the cancellation.

4.7 Substitute delegates: you (the Client) may transfer a place on an open course to a named delegate free of charge, within 3 working days of the open course taking place.

4.8 Items 4.1-4.7 apply only if open course materials have not been issued to you (the Client). No transfers or refunds are allowable after transfer of open course materials.

 

5. Transferring in-house provision

5.1 Provision of in-house provision and facilitation services does not allow for transfer of dates.

5.2 Provision of retreat services does not allow for transfer of dates or substitute delegates.

 

6. Transferring consultant services

6.1 Provision of consultant services allows for the transfer of dates within the timelines specified below:

6.2 Should you (the Client) fail to attend a scheduled appointment without notice (or without less than 24 hours notice), the appointment fee/charge will non-refundable and non-transferrable to a future date.

6.3 Should you (the Client) be more than 10 minutes late for a scheduled appointment without prior notice, The Provider reserves the right to adjust the timing of the service, or terminate the appointment, and the appointment fee/charge will be non-refundable and non-transferrable to a future date. 

6.4 Transfer of substitute delegates for the provision of consultant services is not applicable.

 

7. Cancellation of open courses

7.1 Cancellation of open courses must be received in writing via email at callie@expressyourcurve.co.uk or coach@createavity.com  by The Provider, and must contain full booking details, including delegate name, booking date and contact details.

7.2 Your cancellation will be confirmed in writing, together with an invoice for any fees that may be due. Applicable relevant cancellation timelines and charges are shown below:

  • 25% of fee is non-refundable for open courses cancelled up to 45 calendar days prior to event date
  • 50% of fee is non-refundable for open courses cancelled up to 30 calendar days prior to event date
  • 75% of fee is non-refundable for open courses cancelled up to 14 calendar days prior to event date
  • 100% of fee is non-refundable for open courses cancelled up to 7 calendar days prior to event date

An exception to the cancellation option is that once materials or log-in details have been issued to the delegate, no refund can be made. However, transfer to another date is still an option (see item 4).

7.3 A nominal administrative charge of £10 will be applied to any cancellation request.

7.4 The transfer option only relates to delegates who are transferring to a different date on the same open course.

8.1 Cancellation of in-house provision must be received in writing via email at callie@expressyourcurve.co.uk or coach@createavity.com  by The Provider, and must contain full booking details, including organisation name, course organiser, booking date and course organiser contact details.

8.2 Your cancellation will be confirmed in writing, together with an invoice for any fees that may be due. Applicable relevant cancellation timelines and charges are shown below:

  • 25% of fee is non-refundable for in-house provision cancelled up to 45 calendar days prior to event date
  • 50% of fee is non-refundable for in-house provision cancelled up to 30 calendar days prior to event date
  • 100% of fee is non-refundable for in-house provision cancelled up to 14 calendar days prior to event date

9. Cancellation of consultant services

9.1 Cancellation of consultant services must be received in writing via email at callie@expressyourcurve.co.uk  by The Provider, and must contain full booking details, including organisation name, course organiser, booking date and course organiser contact details.

9.2 Your cancellation will be confirmed in writing, together with an invoice for any fees that may be due. Applicable relevant cancellation timelines and charges are shown below:

  • 25% of fee is non-refundable for in-house provision cancelled up to 21 calendar days prior to appointment date
  • 50% of fee is non-refundable for in-house provision cancelled up to 14 calendar days prior to appointment date
  • 100% of fee is non-refundable for in-house provision cancelled up to 7 calendar days prior to appointment date

9.3 A nominal administrative charge of £10 will be applied to any cancellation request.

9.4 All outstanding invoices will remain due, irrespective of the number of working days notice given for the cancellation.

9.5 The Provider reserves the right to refuse future bookings by you (the Client).

9.6 Cancellation timelines are inclusive of the 14-day cooling-off period.

 

10. Dates and venues for open courses

10.1 The Provider reserves the right to alter course dates and venues without liability.

10.2 In the event of a cancellation where an alternative cannot be provided in respect of a named open course, or in-house provision a refund will be offered.

10.3 The Provider will not reimburse travel or accommodation expenses. The Provider is not able to offer refunds for cancellations outside our control, including adverse weather conditions, flooding or industrial action. Please ensure you take out appropriate insurance cover as soon as you make a booking.

 

11. Open course, in-house provision and consultant services outlines, notes and training

11.1 In order to respond to changes in market demand, The Provider reserves the right to alter outlines, content, training platform, and/or tutors at any point in the future.

11.2 The Provider’s outlines, content, notes and training cannot be relied upon for legal interpretation. Neither The Provider, nor appointed trainers or consultants, can accept responsibility for the actions of delegates or individual participants, or those of other people reading the the materials, or responsibility for any loss incurred as a result of relying on the outlines, content, or training.


All bookings for our open courses, in-house provision or consultant services are subject to the above terms and conditions. Your acceptance of them constitutes a legally binding contract under English Law. You will be deemed to have accepted the terms and conditions at the time of booking if using our website, or for bookings made in any other way, unless we hear from you within seven days of our confirmation of your booking.
